These Terms of Service ("Terms") govern your use of the Drivertise USA website and any advertising services you purchase from us. By submitting a contact form, scheduling a demo, or entering into an advertising agreement with Drivertise USA ("we," "us," "our"), you agree to these Terms.
Drivertise USA is owned and operated by Danyon, an individual doing business in Utah County, Utah.
Drivertise USA provides mobile advertising services including:
Specific terms for each service, including zone assignments, routes, impression estimates, and deliverables, are confirmed in writing (via email or service agreement) prior to campaign activation.
Month-to-month plans are billed at the start of each calendar month. Payment is due before campaign activation for the new billing period. Late payment may result in temporary suspension of campaign activity.
6-month plans are billed as a single upfront payment covering the full 6-month term. No refunds are issued for unused months if the client elects to end the campaign early.
Direct mail co-op billing follows a two-stage payment process:
If a client declines the proof and chooses not to proceed, the 50% deposit is non-refundable as it covers zone reservation, design, and proof production costs. Design services requested beyond basic ad formatting are quoted and billed separately, and are not included in the mailer space pricing.
Accepted payment methods will be confirmed during the onboarding process. All prices are in US dollars.
Month-to-month clients may cancel by providing written notice (email or text is acceptable) at least 30 days before the next billing date. Campaign activity continues through the end of the paid billing period. No penalty fees apply.
6-month clients may not cancel mid-term without forfeiting the remaining pre-paid balance, as the discounted rate was contingent on the full commitment. Exceptions may be considered at our sole discretion in cases of documented business closure.
Upon cancellation, client creative is removed from the vehicle, tracking links are deactivated, and the zone is released back to the available pool.

Drivertise USA does not guarantee any specific number of leads, sales, customers, or revenue resulting from any advertising campaign. Impression estimates are based on industry averages for high-traffic routes in Utah County and may vary based on traffic conditions, weather, seasonality, and other factors outside our control.
Advertising effectiveness depends on many variables beyond our control, including but not limited to: the quality and relevance of your creative, the strength of your offer, your business's ability to convert inquiries, and local market conditions.
Any ROI estimates or projections shared in demos, on our website, or in communications are illustrative only and do not constitute a guarantee.
You retain ownership of all creative materials you provide to us. By submitting creative, you grant Drivertise USA a limited, non-exclusive license to reproduce and display your creative for the purpose of fulfilling your advertising campaign.
We may photograph or record the vehicle displaying your ad for purposes of reporting, quality assurance, and internal documentation. If we wish to use images of your ad for marketing or promotional purposes (e.g., on our website or social media), we will request your permission before doing so.
To the maximum extent permitted by applicable law, Drivertise USA's total liability to you for any claims arising from or related to our services shall not exceed the total amount paid by you in the 30 days preceding the claim.
We are not liable for indirect, incidental, special, or consequential damages, including lost profits or loss of business, even if we have been advised of the possibility of such damages.
We are not liable for any damage to the advertising vehicle caused by third parties, weather events, vandalism, or normal wear and tear.
These Terms are governed by the laws of the State of Utah, without regard to its conflict of law provisions. Any disputes arising under these Terms will be resolved in the appropriate courts of Utah County, Utah.
We may update these Terms periodically. We will notify active clients of material changes via email before they take effect. Continued use of our services after the effective date of changes constitutes acceptance of the updated Terms.
For website visitors who have not entered into a service agreement, continued use of the website after updates constitutes acceptance.
